Terms of Service

SetMates is an online platform where photographers, models, content creators, organizers and brands create professional profiles, show portfolios, find each other, post collaboration opportunities, offer services and book time. In these terms, “SetMates”, “we” and “us” mean the operator of the platform, and “you” means the person using it.

SetMates provides the tools. The work itself — a shoot, a session, a campaign — is arranged between members. SetMates is not a party to those arrangements and is not an employer, an agency, a broker or a payment processor.

SetMates is in a closed beta. Accounts can only be created with an invitation code, and a code may be limited in how many times it can be used and how long it stays valid. Do not publish or sell a code you were given.

Beta software changes. Features may be added, changed or removed, and the service may be unavailable at times. We may end the beta, or move it to a different form, and will tell members by email before we do.

• You must be at least 18 years old. You confirm this at sign-up and give your date of birth when you set up your profile; accounts found to belong to someone under 18 are removed.
• One person, one account. If you act for a business or brand, you must be allowed to act for it, and it is bound by these terms too.
• You may not use SetMates if we have previously removed your account, unless we have told you otherwise.

• Give accurate information about yourself and your work, and keep it up to date.
• Keep your password to yourself. You are responsible for what happens under your account; tell us promptly if you think someone else has used it.
• You must confirm your email address before you can use your account. We send account email only for things like confirming your address and resetting your password.

You keep ownership of what you upload: photographs, profile text, service descriptions and messages. You give SetMates a non-exclusive, worldwide, royalty-free permission to host, store, copy, resize and display that content, only as needed to run the platform and show it to the people you have chosen to show it to. That permission ends when you delete the content or your account, apart from copies we must keep for the reasons set out in the Privacy Policy.

By uploading content you confirm that:

• you have the rights to share it, including the agreement of other creatives who worked on it where that is needed;
• everyone identifiable in it agreed to be photographed and to the image being shared this way;
• it follows the Content Policy.

Follow the Community Guidelines. In particular, you may not:

• harass, threaten, exploit or discriminate against anyone;
• impersonate someone, or misrepresent who you are, your work or your experience;
• use SetMates for sexual services, or to contact anyone under 18;
• send spam, or collect other members’ information for purposes they did not agree to;
• defraud anyone, including by taking payment for work you do not intend to do;
• try to get around a block, a suspension, a rate limit or the invitation requirement, or to access accounts or data that are not yours;
• interfere with the platform, including by scraping it or attempting to break its security.

When you collaborate with, book, or are booked by another member, the agreement is between you and them. You are responsible for agreeing the details — the brief, dates, usage rights, cancellation terms and any payment — and for keeping to them.

SetMates does not check members’ identity, qualifications, insurance or the accuracy of what they publish, and does not guarantee that a collaboration or booking will happen as agreed. Read the Safety Guidelines before meeting anyone.

SetMates does not process payments. There is no checkout, escrow, deposit holding, refund or payment protection. When work is paid, the members involved agree the price and arrange payment directly with each other, by whatever method they choose and at their own risk.

A booking or order may let members record that payment was arranged or received. That is a note both sides can see, not a confirmation from SetMates that any money has moved. SetMates does not charge members fees during the closed beta.

After a collaboration, the people involved can review each other. Reviews stay hidden until both have been written or the review window has closed, so neither side can respond to the other’s first. Reviews must be honest and about the collaboration itself. We may hide a review that breaks these terms.

Anyone signed in can report a profile, portfolio image, opportunity, service, message, review or invitation, and block another member. People at SetMates review reports. We may remove or hide content, warn a member, restrict features, or suspend or close an account when we believe these terms or our policies have been broken, or to protect members or the platform. Every moderation action is recorded with the reason for it.

If you think we got a decision wrong, reply to the person at SetMates who sent your invitation, and we will look at it again.

You can deactivate your account at any time and come back later, or ask for it to be deleted. Deletion happens after a 14-day grace period in which you can change your mind. What is removed and what is kept is described in the Privacy Policy.

SetMates is a beta service provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, and we are not responsible for the conduct of members, for what they publish, or for arrangements made between them, including payment.

To the extent the law allows, SetMates is not liable for indirect or consequential loss, or for loss of income, data or opportunity, arising from your use of the platform. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer where you live.

We will update these terms as the product changes. If a change materially affects your rights, we will tell you by email or in the app before it takes effect. The date at the top of this page shows when they last changed.
